Gov. DeSantis works to repeal Florida’s Red Flag Law

Republican Florida Gov. Ron DeSantis said he wanted to repeal Sunshine State’s Red Flag Act, believing it violated the Second Amendment rights of gun owners.
The governor announced his intentions in his national speech on Tuesday.
Dangerous laws in the state were signed by Goff at the time. Republican Rick Scott, now a U.S. Senator, has 17 people killed after a mass shooting at Marjory Stoneman Douglas High School in Parkland in February 2018.

The legislation allows law enforcement to seek court orders to confiscate guns from people deemed to pose a threat to themselves or others and prevent them from buying more weapons in the future. This is unlike other states with dangerous laws, where family members and roommates can also ask the court to confiscate guns.
Florida law also raises the minimum legal age for buying guns in Florida to 21.
DeSantis believes that red flag laws or risk protection orders are unconstitutional. He said he would veto the law if he signed it in 2018.

“If you look at this dangerous law that has been passed, they can go in and say, ‘This person is a danger and they should take the gun away’,’ it’s property related to constitutional rights,” DeSantis said. “The burden shifts the place you have to prove to the court that you are not a threat or threat. It’s not how due process works.”
Fox13 shows that law enforcement agencies across the state have filed nearly 10,000 risk protection order petitions.

No bill was introduced in either chamber of the Florida Legislature to repeal dangerous laws.
