South Carolina drunk driver arrested 3 times in December: Affidavit

Last week, a South Carolina grand jury indicted an illegal immigrant in the United States who had been readmitted after a December arrest for drunken driving.

Sergio Ixtepan-toto, 36, was arrested in Pickens, South Carolina on December 6, 2024 after he nearly hit Another car was hit on the town’s West Main Street.

When a Pixar police officer tried to pull Ixtepan-toto over, he allegedly ran a stop sign and continued driving until he was stopped by police in the store parking lot.

During the stop, officers reported that Ixtepan-toto failed a field sobriety test and had multiple open beer cans in his vehicle.

An incident report also said he had a Mexican ID, Fox Carolina reported.

Ixtepan-toto was released locally on December 9 and taken into custody by Immigration and Customs Enforcement agents.

An affidavit filed by a deportation officer on Dec. 12 states that Ixtepan-Toto’s immigration file shows he was deported in May 2020, November 2022 and February 2024.

“There is no record that Ixtepan ever received permission from the U.S. Attorney General or his successor as Director of Homeland Security to reapply to INS or ICE following his arrest and deportation,” the affidavit states.

A background check on ixtepan-toto obtained by Fox Carolina shows criminal charges in various jurisdictions within the state dating back to 2008.

His previous charges include speeding, driving without a driver’s license, domestic violence, indecent exposure and a previous arrest for driving under the influence.
